§ 7145. Precedence of Commonwealth Building Safety Code. [Effective 180 days after Dec. 19, 2019, this section shall read as follows:] (a) Where conflicts or contradictions exist between provisions of the Building Safety Code or regulations issued hereunder and the International Building Code, the Commonwealth regulations or Building Safety Code shall apply. (b) Reference in the International Building Code to the “Building Official” shall be taken to mean the Building Safety Official of the Department of Public Works, as established herein. (c) No fees or inspections, nor any certificate of approval, or occupancy required by the International Building Code shall be required in the Commonwealth unless such requirement is specifically adopted by regulation. Prior to its repeal and reenactment, this section read as follows: (a) Where conflicts or contradictions exist between provisions of this code or the regulations issued hereunder and the Uniform Building Code or the CABO Code, then the Commonwealth building safety code shall apply. (b) Reference in the Uniform Building Code or the CABO Code to the “building official” or the “board of appeals” shall be taken to mean the building safety official or Building Safety Code Review Board, respectively, as established herein. (c) No inspection, nor any certificate of approval, inspection, or occupancy required by the Uniform Building Code or the CABO Code shall be required in the Commonwealth unless such requirement is specifically adopted by regulation by the Building Safety Division or by amendment of this building safety code by the legislature.
