§ 7805. Unrestricted Patient Origination. A health insurance issuer or health benefit plan shall not impose any unique conditions for coverage of mental health services delivered by telehealth mental health. A health insurance issuer shall not impose any originating site restrictions, nor distinguish between patients in rural or urban locations, nor impose any geographic or distance-based restrictions, when providing coverage for health care services delivered by telehealth. A health benefit plan shall not restrict the type of telehealth technology, including the type of software or platform that a mental health services provider may use to deliver services. Mental and/or behavioral health services providers shall, however, use HIPAA-compliant technologies to deliver mental and/or behavioral health services by telehealth.
