§ 8193. Private Sector Procurement, Employment and Agency Status. A business that is a party to a PSAA remains a private sector entity and shall not be subject to: (a) Treatment as a public sector agency or instrumentality by virtue of its contract and scope of work; provided that CUC may by contract extend to it limited legal liability and immunity protections if such extension is approved by the Attorney General. (b) CUC or CNMI procurement regulations, with respect to procurements undertaken by it within the scope of its work. (c) Commonwealth employment laws and regulations that are applicable solely to the public sector, with respect to decisions made by it within the scope of its work. Source: PL 16-17 § 5.
