§ 8263. Administrative Leave for Disaster Service Volunteers. An employee of an agency who is a disaster service volunteer of the American Red Cross may be granted administrative leave from work with pay for not more than 15 working days in any 12-month period to participate in disaster relief services for the American Red Cross, upon the request of the American Red Cross for the services of that employee and upon the approval of that employee’s state agency, without loss of seniority, pay, annual leave, compensatory time, sick leave or earned overtime accumulation. The agency shall compensate an employee granted administrative leave under this section at the employee’s regular rate of pay for those regular work hours during which the employee is absent from work. An employee deemed to be on leave under this section shall not be deemed to be an employee of the state for purposes of the Commonwealth tort claims act [7 CMC § 2201 et seq.]. Leave under this article shall be granted only for services related to a disaster occurring within the Commonwealth. Source: PL 9-63, § 3.
