§ 8355. Contingency Benefit. If it is determined that a class I or class II member would have been eligible for a benefit under the Northern Mariana Islands Social Security System or United States Old Age, Survivor and Disability Insurance but is not eligible for a benefit as otherwise provided in this part, such member will be deemed to meet the eligibility requirements for the appropriate benefit under this part.
