§ 9142. Wrongful Death. Notwithstanding anything contained in title 7, division 2, chapter 1 (commencing at 7 CMC § 2101), whenever the death of a seaman, resulting from an injury, is caused by wrongful act, omission, neglect or default occurring on board a vessel, the personal representative of the deceased seaman may maintain a suit for damages, for the exclusive benefit of the deceased’s spouse, parent, child, or dependent relative, against the vessel, person or corporation which would have been liable if death had not ensued.
