§ 9223. Issuance and Service of Summons. (a) The Clerk of Courts shall issue a summons containing the names of the parties, a general description of the whole property, or a reference to the complaint for the description of the land, and a notice to the defendants to appear in the proceedings. When the defendants are known the summons shall be served by delivering to them a copy of the summons along with a copy of the complaint. If the defendants, whether known or unknown, cannot be found, then a copy of the summons and complaint shall be posted as follows: (1) On the property; (2) On the administration building or such other place where public notices are usually posted; (3) At a public place in a village located near the property; and (4) By delivering one copy of the summons and complaint to the mayor of the island on which the property is situated. (b) The service of the summons and complaints or the posting of them as provided in this section is sufficient to give the Commonwealth Trial Court jurisdiction to proceed with and finally determine the case. Commission Comment: Section 4 of PL 6-25, the “Commonwealth Judicial Reorganization Act of 1989,” provides that “[w]herever the term ‘Commonwealth Trial Court’ appears in the Commonwealth Code, it is henceforth to be interpreted and understood to refer to the Commonwealth Superior Court.”
