§ 9313. Lottery Commission: Licenses. (a) Before issuing a license, the commission shall consider factors such as: (1) The financial responsibility and security of the person and his or her business activity; (2) The appropriateness of the location at which the person intends to conduct the lottery; (3) The sufficiency of existing licenses to serve the public convenience; and (4) The volume of expected sales. (b) As used in this section “person” includes an individual, association, corporation, club, trust, estate, society, company, joint stock company, receiver, trustee, any other person acting in a fiduciary or representative capacity, or any combination of individuals. “Person” includes any department, commission, agency or instrumentality of the Commonwealth, including any municipality or political subdivision and any agency or instrumentality thereof. “Person” excludes any religious or other nonprofit organization. (c) Notwithstanding any other provision of law, a person licensed pursuant to this chapter may operate or be engaged in the operation of the lottery, pursuant to this law and the regulations governing such activity. A person lawfully engaged in nongovernmental business on Commonwealth or federal property may be licensed. (d) A license shall not be assignable or transferrable. (e) The commission may issue temporary licenses upon such conditions as it deems necessary for a term not to exceed 90 days. (f) The commission may impose fees for any licenses and may require a bond from any licensed person, in an amount provided by regulation. (g) A licensed person shall display his or her license or a copy of it conspicuously in accordance with the regulations. (h) The commission may suspend or revoke, with or without prior hearing, the license of any person who violates this chapter or a regulation promulgated pursuant to this chapter. The commission shall comply with the Administrative Procedure Act (1 CMC § 9101 et seq.). (i) The license requirement established by this section shall be in addition to those required by 4 CMC § 1503. Source: PL 3-60, § 12.
