§ 9318. Use of Commonwealth Lottery Fund. If a Commonwealth Lottery Fund-Prize Trust account is established, the commission may draw from the funds deposited pursuant to 1 CMC § 9307 those sums of money needed to pay prizes won in the Commonwealth lottery. The operations of the commission shall be funded by appropriation of the legislature from the General Fund of the Commonwealth, which appropriated funds shall be deposited in the Commonwealth Lottery Fund-Administration account. All other revenues received by the commission shall be deposited in the Commonwealth Lottery Fund-General Lottery account. Not less than 10 days before making its annual report as required by 1 CMC § 9308, the commission shall transfer the balance of all earned revenue and interest not needed to pay prizes in prior lotteries to the Commonwealth Lottery Fund-General Lottery account. No fund in the Commonwealth Lottery Fund-General Lottery account shall be disbursed except pursuant to appropriation enacted by the legislature. Source: PL 3-60, § 18. Commission Comment: With respect to the references to the Lottery Commission, see Executive Order 94-3 (effective August 23, 1994), reorganizing the executive branch, changing agency names and official titles, and effecting other changes, set forth in the Commission comment to 1 CMC § 2001; see also the comment to 1 CMC § 9301. The January 1997 edition of this code was missing the third sentence of this section that reads, “All other revenues received by the Commission shall be deposited in the Commonwealth Lottery Fund-General Lottery account.”. This sentence has been placed back in this section to correct this error.
