Transfer

Act 105 of 1937, § 407, under "MILK MARKETING LAW".

Act 105 of 1937, § 407

Section 407. Transfer.--Licenses issued under this act may not be assigned. Licenses may, however, be transferred from one person to another, provided that the prior written approval of the board to such transfer is obtained; but a receiver, an executor or administrator who succeeds to the business of a licensee may continue the business for a period of two weeks, if otherwise authorized by law, without securing the prior approval of the board. Any change in the membership of a partnership or limited partnership, either by the withdrawal or the addition of a partner, shall be construed to require a transfer of the license. Applications for such transfers shall be filed with the board at least one week before the transfer is to be made, or, in the case of a receiver or an executor or administrator, within two weeks after he takes possession of the business of the licensee. Whenever any license is transferred, no license fee shall be required from the person to whom such transfer is made for the balance of the then current license year, except the transfer fee of one dollar.

Compiler's Note: Section 11(b) of Act 132 of 1978 provided that section 407 is repealed to the extent it sets fees for licenses, certificates or activities for which new fees are prescribed by Act 132.
