Section 39. Prior Liability.--The enactment of this act shall not have the effect of terminating, or in any way modifying, any liability, civil or criminal, which shall already be in existence on the date this act becomes effective.
Compiler's Note: Section 42 of this act provided that the provisions of this act shall become effective six months after the approval of the State plan by the Administrator of the Federal Environmental Protection Agency. The State plan was approved on August 8, 1977 (42 FR 41907). The provisions of this act took effect on February 8, 1978.
