Section 3

Act 402 of 1945, § 3, under LIMITED ACCESS HIGHWAY LAW.

Act 402 of 1945, § 3

Section 3. The Secretary of Transportation, with the approval of the Governor, or local authorities in connection with the designation or construction of a limited access highway may lay out or construct local service highways. Such local service highways shall be so located as to permit the establishment by private owners or their lessees of adequate fuel and other service facilities for the users of limited access highways. The location of such facilities may be indicated to the users of the limited access highways by appropriate signs, the size and location of which shall be determined by the authorities having jurisdiction. No commercial enterprise or activity shall be located or authorized by the State or by any political subdivision thereof, within or on any public property which is part of the right of way of any limited access highway, except that communication facilities and vending machines may be located at roadside rests.

Compiler's Note: Section 2 of Act 88 of 2012 provided that section 3 is repealed insofar as it is inconsistent with 74 Pa.C.S. Ch. 91 (relating to pubic-private transportation partnerships).
