Informal appointment proceedings--Clerk not satisfied

SDCL § 29A-3-309 — under PROBATE OF WILLS AND ADMINISTRATION.

SDCL § 29A-3-309

The clerk may decline an application for informal appointment if not satisfied that a requested informal appointment of a personal representative should be made because of failure to meet the requirements of §§ 29A-3-307 and 29A-3-308 or for any other reason. A declination of informal appointment is not an adjudication and does not preclude appointment in formal proceedings. Source: SL 1994, ch 232 , § 3-309; SL 1995, ch 167 , § 109.
