SDCL § 3-4-2 — under VACANCIES IN OFFICE.

SDCL § 3-4-2

Resignations may be made as follows: (1) Of all state and district officers, either elective or appointive, to the Governor; (2) Of all members of the Legislature to the presiding officer of its branches respectively when in session, and when not in session to the Governor; and when made to the presiding officer he shall at once notify the Governor; (3) Of all officers of the Legislature to the respective branches thereof; (4) Of all elective county officers, by filing with the county auditor such resignation in writing, which shall be filed or deposited with the board of county commissioners, which resignation unless a different time is fixed therein shall take effect upon such filing; (5) Of officers of civil township to the board of supervisors of the township, except of members of such board, which shall be to the township clerk; and notice shall forthwith be given by the township clerk to the county auditor of the resignation of all officers whose bonds are filed with that officer; (6) Of all officers holding office by appointment to the body, board, court, or officer that appointed them.
