Conditions constituting adulteration of dessert or mix

SDCL § 39-8-11 — under FROZEN DESSERTS.

SDCL § 39-8-11

A frozen dessert or mix shall be deemed adulterated for purposes of this chapter: (1) If it bears or contains any poisonous or deleterious substance which may render it injurious to health; (2) If any valuable constituent has been in whole or in part omitted or abstracted therefrom or if any substance has been substituted in part or in whole; (3) If it does not conform with the definitions, standards, or other requirements as set forth for the same in this chapter or by rule promulgated pursuant to chapter 1-26 .
