(a) The department of environment and conservation has the power to:(1) Exercise all functions, rights, powers, and duties vested by law; and(2) Make rules and regulations not inconsistent with law for the administration of such functions and duties, and for the management of any parks or other properties belonging to the state.

(b) All federal aid as defined by § 4-4-116(a) received or used by the department must be acquired and used subject to the requirements of § 4-4-116.
