(a) Every person hunting big game except turkey during the gun hunts proclaimed by the commission shall wear, on both the upper portion of the body and head, outer garments of daylight fluorescent orange or daylight fluorescent pink color of not less than a combined five hundred square inches (500 sq. in.) and visible from the front and back.

(c) A violation of this section is a Class C misdemeanor.
(d) This section does not apply to a person hunting on that person's own property.
(e) Notwithstanding § 8-21-401, the court costs imposed or assessed against any person convicted of a violation of this section may not exceed the maximum fine amount that may be imposed for a violation of this section.
