Production of Evidence

Sec. 246.113. PRODUCTION OF EVIDENCE. (a) In an investigation or proceeding under this chapter, the board may: (1) require or allow a person to file a written statement regarding any of the facts and circumstances concerning the matter to be investigated; (2) administer oaths and affirmations; (3) subpoena witnesses; (4) compel attendance; (5) take evidence; and (6) require the production of any books, papers, correspondence, memoranda, agreements, or other documents or records considered relevant to the inquiry. (b) The board may bring suit in district court to enforce a subpoena if the person to whom a subpoena is directed fails to comply. Acts 1989, 71st Leg., ch. 678, Sec. 1, eff. Sept. 1, 1989.
