Estoppel

Sec. 315.093. ESTOPPEL. (a) A person who does not bring suit within the period prescribed by Section 315.092 or who does not diligently and in good faith prosecute a suit to final judgment may not contest or raise as a defense in another action the validity of a proceeding or an assessment, lien, or personal liability imposed by the proceeding. (b) Estoppel under this section binds a person's heirs, successors, administrators, and assigns. Acts 1995, 74th Leg., ch. 165, Sec. 1, eff. Sept. 1, 1995.
