Misbranded Molluscan Shellfish and Crabmeat

Sec. 436.071. MISBRANDED MOLLUSCAN SHELLFISH AND CRABMEAT. Molluscan shellfish or crabmeat is misbranded if: (1) its labeling is false, misleading, or fails to conform with the requirements of Section 436.081; (2) it is offered for sale under the name of another food; (3) its container is made, formed, or filled so as to be misleading; (4) a word, statement, or other information required by this chapter or a rule adopted under this chapter to appear on a label is not prominently and conspicuously placed on the label and is not likely to be read and understood by the ordinary individual under customary conditions of purchase and use; or (5) it does not have a label containing: (A) the name, address, and certification or license number of the processor; (B) an accurate statement in a uniform location on the principal display panel of the quantity of the contents in terms of weight, measure, or numerical count; and (C) a date as provided by department rules.
