Effect of Assurance

Sec. 541.352. EFFECT OF ASSURANCE. (a) An assurance of voluntary compliance is not an admission of a prior violation of: (1) this chapter or a rule adopted under this chapter; or (2) Section 17.46, Business & Commerce Code. (b) Unless an assurance of voluntary compliance is rescinded by agreement, a subsequent failure to comply with the assurance is prima facie evidence of a violation of: (1) this chapter or a rule adopted under this chapter; or (2) Section 17.46, Business & Commerce Code.
