Treatment of Certain Conditions As Preexisting Prohibited

Sec. 846.203. TREATMENT OF CERTAIN CONDITIONS AS PREEXISTING PROHIBITED. (a) A multiple employer welfare arrangement may not treat genetic information as a preexisting condition described by Section 846.202 in the absence of a diagnosis of the condition related to the information. (b) A multiple employer welfare arrangement may not treat pregnancy as a preexisting condition described by Section 846.202. Added by Acts 2001, 77th Leg., ch. 1419, Sec. 1, eff. June 1, 2003.
