Rights of Purchaser Other Than Secured Party

Sec. 31.058. RIGHTS OF PURCHASER OTHER THAN SECURED PARTY. (a) In this section, "buyer in ordinary course of business" has the meaning assigned by Section 1.201, Business & Commerce Code. (b) A buyer in ordinary course of business has the protections afforded by Sections 2.403(b) and 9.320(a), Business & Commerce Code, regardless of whether: (1) an existing certificate of title was signed and delivered to the buyer; or (2) a new certificate of title listing the buyer as owner of record was issued. (c) Except as provided by Sections 31.053 and 31.0582, the rights of a purchaser of a vessel or outboard motor that is not a buyer in ordinary course of business or a lien creditor are governed by the Business & Commerce Code.
