13-1a-106. Authority of director.
The director may:
(1) make rules in accordance with, to administer the responsibilities of the division; Title 63G, Chapter 3, Utah Administrative Rulemaking Act
(2) investigate, upon receiving a complaint, the corporation and commercial code filings and compliance governed by a law the division administers and enforces;
(3) bring an administrative or civil action in a court with jurisdiction;
(4) in accordance with Title 63G, Chapter 4, Administrative Procedures Act: take administrative action against a person that violates a division rule or a law that the division administers, including issuing a cease and desist order; and hold or cause to be held administrative hearings regarding a matter affecting: the division; or the incorporation or registration activities of a business governed by a law administered by the division;
(5) for a purpose described in this chapter or any chapter the division administers: administer an oath; issue a subpoena; compel the attendance of a witness; and compel the production of papers, books, accounts, documents, and evidence; and
(6) designate an individual to carry out an action described in Subsection. (5)
