26B-4-245. Purchasing and use limitations.
(1) An individual with a medical cannabis card: may purchase, in any one 28-day period, up to the legal dosage limit of: unprocessed cannabis in a medicinal dosage form; and a cannabis product in a medicinal dosage form; may not purchase: except as provided in Subsection, more medical cannabis than described in Subsection; or (2) (1)(a) if the relevant recommending medical provider did not recommend directions of use and dosing guidelines, until the individual consults with the pharmacy medical provider in accordance with Subsection, any medical cannabis; and 26B-4-231(5) may not use a route of administration that the relevant recommending medical provider or the pharmacy medical provider, in accordance with Subsection, has not recommended. 26B-4-231(5)
(2) A recommending medical provider may petition the department to waive the 28-day period limit described in Subsectionfor a medical cannabis cardholder if the medical cannabis cardholder: (1)(a) has been diagnosed with a terminal illness; has a life expectancy of six months or less; and needs the waiver for palliative purposes. The department shall: consult with the Compassionate Use Board to determine whether the waiver should be granted; and issue a response to the petition within 10 days from the day on which the petition is received. The department may waive the 28-day period limit for no more than 180 days. A petition described in this Subsectionmay be combined with the petition described in Subsection. (2) 4-41a-112(5)
