40-13-204. Forfeiture of surety.
(1) Subsectionapplies if the board determines that an operator has neglected, failed, or refused to: (2) plug and abandon a brine well; close any surface impoundment; repair a brine well leaking or causing waste; or maintain and reclaim a site.
(2) A person who violates Subsectionshall forfeit from the person's surety or shall pay to this state a sum equal to the cost of: (1) plugging a brine well; closure of the surface impoundment; repair of the brine well leaking or causing waste; or reclamation of the site.
