40-14-203. Final permit decision by division -- Appeal.
(1) The division shall conduct a final technical review and make a final administrative decision for a permit application upon completion of an expedited review. To make a final administrative decision on a permit application, the division shall: review a preliminary permit decision for the permit application; conduct a final technical review of the permit application; and approve the permit application; deny the permit application; or return the permit application to the applicant with a description of the permit application's deficiencies.
(2) Except as otherwise provided in this title, a permit applicant may appeal the division's final administrative decision as provided in Section. 40-8-13.1
