53-29-305. Failing to register or providing false or incomplete information -- Failing to comply with monitoring program -- Penalties.
(1) An offender who knowingly fails to register under this chapter, knowingly provides false or incomplete information, or knowingly fails to comply with the sex offender monitoring program described in Section, is guilty of: 53-29-406 a third degree felony and shall be sentenced to serve a term of incarceration of not less than 30 days and also at least one year of probation if: the offender is required to register for a registrable offense that is a felony or adjudicated delinquent for a registrable offense committed before May 3, 2023, that would be a felony if the juvenile were an adult; or the offender is required to register for the offender's lifetime as described in Subsection; or 53-29-203(1)(b) a class A misdemeanor and shall be sentenced to serve a term of incarceration of not less than 30 days and also at least one year of probation if the offender is required to register for a misdemeanor conviction that is a registrable offense or is adjudicated delinquent for a registrable offense committed before May 3, 2023, that would be a misdemeanor if the juvenile were an adult.
(2) The court or Board of Pardons and Parole may not release an individual who violates this chapter from serving the term required under Subsection. (1) This Subsectionsupersedes any other provision of the law contrary to this chapter. (2)
(3) The offender shall register for an additional year for every year in which the offender does not comply with the registration requirements of this chapter.
