58-1-112. Data collection.

(1) As used in this section: "Council" means the Utah Health Workforce Advisory Council created in Section. 26B-1-425 "Information center" means the Utah Health Workforce Information Center created in Section. 26B-4-705

(2) In accordance with Subsection, the department shall work with the information center to identify relevant data pertaining to a profession described in Subsection. 26B-4-705(3)(a) (3) The data should focus on: identifying workforce shortages; identifying labor market indicators; determining the educational background of a licensee; and determining whether Utah is retaining a stable health workforce. After the council approves data to be collected, the department shall request the data from a licensee when a licensee applies for a license or renews the licensee's license. The department shall send the obtained data to the information center. A licensee may not be denied a license for failing to provide the data described in Subsectionto the department. (2)(c)

(3) The department shall prioritize data collection for each profession licensed under:; Chapter 31b, Nurse Practice Act; Chapter 60, Mental Health Professional Practice Act; Chapter 61, Psychologist Licensing Act; Chapter 67, Utah Medical Practice Act; Chapter 68, Utah Osteopathic Medical Practice Act; or Chapter 69, Dentist and Dental Hygienist Practice Act. Chapter 70a, Utah Physician Assistant Act After the department has collected data for each profession described in Subsection, the department shall collect data for each profession licensed under: (3)(a); Chapter 5a, Podiatric Physician Licensing Act; Chapter 17b, Pharmacy Practice Act; Chapter 24b, Physical Therapy Practice Act; Chapter 40, Recreational Therapy Practice Act; Chapter 41, Speech-Language Pathology and Audiology Licensing Act; Chapter 42a, Occupational Therapy Practice Act; Chapter 44a, Nurse Midwife Practice Act; or Chapter 54, Radiologic Technologist, Radiologist Assistant, and Radiology Practical Technician Licensing Act. Chapter 57, Respiratory Care Practices Act The department shall collect data in accordance with this section for any health-related occupation or profession that is regulated by the department and is not described in Subsectionorif: (3)(a) (b) funding is available; the council has identified a need for the data; and data has been collected for each profession described in Subsectionsand.
