58-37f-102. Definitions.
(1) The definitions in Sectionapply to this chapter. 58-37-101
(2) As used in this chapter: "Board" means the Utah State Board of Pharmacy created in Section. 58-17b-201 "Business associate" is as defined under the HIPAA privacy, security, and breach notification rules in 45 C.F.R. 164.502(a), 164.504(e), and 164.532(d) and (e). "Database" means the controlled substance database created in Section. 58-37f-201 "De-identified" is as defined in 45 C.F.R. 164.502(d) and 164.514(a), (b), and (c). "Health care facility" is as defined in Section. 26B-2-201 "Mental health therapist" is as defined in Section. 58-60-102 "Pharmacy" or "pharmaceutical facility" is as defined in Section. 58-17b-102 "Prospective patient" means an individual who: is seeking medical advice, medical treatment, or medical services from a practitioner; and the practitioner described in Subsectionis considering accepting as a patient.
