58-55-108. Term of license -- Expiration -- Renewal and reinstatement.
(1) The division shall issue a license for a term of two years as the division establishes by rule the division makes in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act. The division may extend or shorten a license term by up to one year to stagger renewals as the division determines by rule in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act. Notwithstanding Subsectionsandand Title 63G, Chapter 4, Administrative Procedures Act, the division may suspend a license 60 days after the day on which the licensee: (1)(a) (b) becomes an unincorporated entity subject to the ownership status report filing requirements in accordance with Section; or 58-55-112 transfers the license to an unincorporated entity subject to the ownership status report filing requirements in accordance with Section. 58-55-112 Subsectionmay not apply if before the 60-day period ends: (1)(c)(i) the licensee submits an application to renew the license; and the division renews the license under the submitted application.
(2) The division shall renew or reinstate an individual license after the applicant: submits an application in the individual's name; completes the number of hours of continuing education under Section, if the applicant is: 58-55-304 an apprentice electrician as defined in Section; 58-55-301 a journeyman electrician as defined in Section; 58-55-301 a master electrician as defined in Section; 58-55-301 a residential journeyman electrician as defined in Section; or 58-55-301 a residential master electrician as defined in Section; 58-55-301 completes the number of hours of continuing education under Section, if the applicant is: 58-55-405 an apprentice plumber as defined in Section; 58-55-401 a journeyman plumber as defined in Section; 58-55-401 a master plumber as defined in Section; 58-55-401 a residential journeyman plumber as defined in Section; or 58-55-401 a residential master plumber as defined in Section; and 58-55-401 meets all other requirements of this chapter. The division shall renew or reinstate a contractor's license after the applicant: submits the application in the name of and on behalf of a contractor; demonstrates the contractor's financial responsibility in accordance with Section; 58-55-205 lists the individual acting as the qualifier for the contractor; provides evidence that the qualifier: has passed the required examination; and has completed continuing education in accordance with Section; and 58-55-204 meets all other requirements of this chapter.
(3) A license expires on the expiration date shown on the license.
(4) In addition to requirements imposed by law, an applicant applying for reinstatement of a license the division suspends or revokes shall: pay fines the division imposes; resolve outstanding citations or disciplinary actions with the division; if the license the division suspends or revokes is a contractor's license, demonstrate financial responsibility in accordance with Sectionusing titled assets; and 58-55-205 if applicable, pay the reimbursement amount as provided in Title 38, Chapter 11, Residence Lien Restriction and Lien Recovery Fund Act.
