58-91-302. Qualifications for licensure.
(1) Each applicant for licensure as a constable shall: be 21 years old or older; be trained and certified as a special function officer in the state, as described in Section; 53-13-105 provide the applicant's name, address, date of birth, social security number, and fingerprints to the division; disclose the applicant's criminal history, if any, on a form the division approves; consent to and complete a criminal background check described in Section; 58-1-301.5 submit an application in a form the division approves; pay a fee determined by the department under Section; 63J-1-504 provide evidence that the applicant carries or will carry the minimum required insurance; and meet with the division and board, if requested by the division or the board.
(2) The division may not issue a license to an applicant who: has a conviction for an act which, when considered with the functions and duties imposed by Title 58, Occupations and Professions: bears a substantial relationship to the applicant's ability to safely or competently perform the duties described in this chapter; or indicates that the best interests of the public are not served by granting the applicant a license; is on probation, parole, community supervision, or named in an outstanding arrest warrant; or has previously violated Section, as evidenced by an uncontested citation, a stipulated settlement, or a finding of a violation in an adjudicative proceeding. 58-91-501
(3) The division and board shall establish by rule, in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the type of insurance coverage and minimum coverage amounts required for: a licensed constable who provides criminal services for a contracting governmental entity, civil services for a contracting governmental entity, and civil services for a client; a licensed constable who provides only civil services for a contracting governmental entity or a client; a licensed constable who provides only civil services for a client; a licensed deputy constable; and a licensed apprentice constable.
