58-92-303. Private investigator agent -- Qualifications for licensure -- Scope of license.
(1) In addition to the requirements of Section, an applicant for licensure as a private investigator agent shall: 58-92-302 submit an application in a form the division approves; pay a fee determined by the department under Section; 63J-1-504 provide proof to the division that the applicant meets each examination and experience requirement for a private investigator agent under Sectionsand; 58-92-307 58-92-308 file and maintain with the division evidence of a surety bond: in the amount the division establishes by rule in collaboration with the board and in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act; that shall remain in effect throughout the applicant's entire licensing period; and that provides that the issuer of the surety bond shall notify the division if the bond is cancelled or expired; and provide the division any other information the division requires by rule in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act.
(2) A private investigator agent may: engage in private investigation independently if the private investigator agent creates a private investigation agency and receives a private investigation agency license in accordance with Section; 58-92-311 if the private investigator agent creates a private investigation agency and receives a private investigation agency license, supervise and employ a private investigator agent, a private investigator registrant, or a private investigator apprentice under the private investigation agency; and engage in private investigation: as the employee of a private investigator agent with a valid and current license; or while under contract and supervision of a private investigator agent with a valid and current license.
(3) A private investigator agent may not supervise or employ a private investigator agent, a private investigator registrant, or a private investigator apprentice unless the private investigator agent creates a private investigation agency and receives a private investigation agency license.
(4) The division may further define the scope of the private investigator agent license by rule in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act.
