63A-19-203. Utah Privacy Commission created.
(1) There is created the Utah Privacy Commission.
(2) The commission shall be composed of no more than 14 members. The governor shall appoint: one member who, at the time of appointment provides internet technology services for a county; one member with experience in cybersecurity; one member representing private industry in technology; one member representing law enforcement; one member with experience in data privacy law; and one member who is a private citizen representing the public. The State Board of Education shall appoint one member representing public education entities and the privacy interests of students. The state auditor shall appoint: one member with experience in internet technology services; one member with experience in cybersecurity; one member representing private industry in technology; one member with experience in data privacy law; and one member representing municipalities. The attorney general shall appoint: one member with experience as a prosecutor or appellate attorney and with experience in data privacy or civil liberties law; and one member representing law enforcement.
(3) Except as provided in Subsection, a member is appointed for a term of four years. (3)(b) The initial appointments of members described in Subsections (2)(b)(i) through, (2)(d)(iv) and (v), and (2)(e)(ii) shall be for two-year terms. (iii) When the term of a current member expires, a member shall be reappointed or a new member shall be appointed in accordance with Subsection. (2)
(4) When a vacancy occurs in the membership for any reason, a replacement shall be appointed in accordance with Subsectionfor the unexpired term. (2) A member whose term has expired may continue to serve until a replacement is appointed.
(5) The commission shall select officers from the commission's members as the commission finds necessary.
(6) A majority of the members of the commission is a quorum. The action of a majority of a quorum constitutes an action of the commission.
(7) A member may not receive compensation or benefits for the member's service but may receive per diem and travel expenses incurred as a member of the commission at the rates established by the Division of Finance under: Sectionsand; and 63A-3-106 63A-3-107 rules made by the Division of Finance in accordance with Sectionsand. 63A-3-106 63A-3-107
(8) A member shall refrain from participating in a review of: an entity of which the member is an employee; or a technology in which the member has a financial interest.
(9) The office shall provide staff and support to the commission.
(10) The commission shall meet up to 12 times a year to accomplish the duties described in Section. 63A-19-204
(11) The commission shall, in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, make rules establishing participation requirements for commission members. A commission member who fails to meet the participation requirements established under Subsectionmay be removed by the official who appointed the member in accordance with Subsection. (11)(a) (2)
