63A-5b-1209. Historical project documentation and information requests.
(1) Upon written request from the division, an LEA shall provide: in accordance with Subsection, documentation and information regarding construction projects; (7) cost data, construction documents, and project records; contractor and vendor information and performance records; change order documentation and justifications; inspection records and certificates of occupancy; as-built drawings and project closeout documentation; warranty information and maintenance records; and any other project-related information the division determines necessary for: establishing cost benchmarks and databases; analyzing construction cost trends; developing standardized design templates; creating training programs and best practices; or other purposes related to public school construction oversight.
(2) An LEA shall provide requested information: within 90 days of receiving the division's written request; in the format specified by the division; organized and indexed for efficient review; with complete documentation for each requested project; and at no cost to the division.
(3) If an LEA is unable to provide requested information within 30 days due to volume or complexity, the LEA shall: notify the division within 10 days of receiving the request; provide a detailed explanation of the delay; propose a reasonable timeline for providing the information; and provide interim updates on progress.
(4) The division may use the information collected under this section to: populate the construction cost database described in Section; 63A-5b-1210 establish baseline cost benchmarks; identify best practices and areas for improvement; develop training materials and resources; create standardized design templates; conduct research on construction cost drivers; and provide better technical assistance to an LEA.
(5) The division shall: maintain the confidentiality of proprietary information submitted by an LEA; use submitted information only for the purposes described in this section; aggregate data when publishing reports or benchmarks to protect LEA-specific information where appropriate; and provide an LEA with access to aggregated data and analysis.
(6) Failure of an LEA to provide requested information without good cause may result in: loss of certain oversight autonomy, including requirement for division-managed construction services under Section; or 63A-5b-1213 administrative penalties not exceeding $5,000, subject to appeal under Section. 63A-5b-1221
(7) This section applies to: all LEAs; projects in process or completed after May 6, 2026; and both new construction and major renovation projects.
