76-18-206. Unlawful failure to use original controlled substance container.

(2) An actor commits unlawful failure to use original controlled substance container if the actor: is an individual to whom, or for whose use, a controlled substance has been prescribed, sold, or dispensed by a practitioner; or is the owner of an animal for which a controlled substance has been prescribed, sold, or dispensed by a veterinarian; and possesses the controlled substance in a manner other than in the container in which the controlled substance was delivered to the actor by the person selling or dispensing the controlled substance.
(3) A violation of Subsectionis a class B misdemeanor. (2)
(4) It is a defense to a prosecution under this section if the actor produces in court a valid prescription for the controlled substance or the original container with the label attached.
