76-5-102.3. Assault or threat of violence against a school employee.
(1) As used in this section: "Assault" means an offense under Section. 76-5-102 "Employee" includes a volunteer. "Threat of violence" means an offense under Section. 76-5-107 Terms defined in Sectionapply to this section. 76-1-101.5
(2) An actor commits assault or threat of violence against a school employee if: the actor commits assault or a threat of violence against an employee of a public or private school; the actor has knowledge that the individual is an employee; and the employee is acting within the scope of the employee's authority as an employee.
(3) A violation of Subsectionis a class A misdemeanor. (2)
