76-6-106.2. Property damage or destruction by a trespasser on real property.
(1) Terms defined in Sectionsandapply to this section. 76-1-101.5 76-6-101
(2) An actor commits property damage or destruction by a trespasser on real property if, under circumstances not amounting to burglary as defined in Sectionor, the actor: 76-6-202 76-6-203 enters or remains unlawfully on real property; and causes damage or pecuniary loss equal to or in excess of $1,500.
(3) A violation of Subsectionis a second degree felony. (2)
