76-8-317. Refusal to comply with an order to evacuate or order issued in a local or state emergency.

(2) An actor commits refusal to comply with an order to evacuate or order issued in a local or state emergency if the actor: receives notice of: an order to evacuate issued under Title 53, Chapter 2a, Emergency Management Act; or an order issued: by the governor in a state of an emergency under Section; or 53-2a-204 by a chief executive officer in a local emergency under Section; and 53-2a-205 refuses to comply with the order described in Subsection (2)(a).
(3) A violation of Subsection (2) is a class B misdemeanor.
