76-8-601. Wrongful commencement of an action in justice court.

(2) An actor commits wrongful commencement of an action in justice court if the actor: is: a party to a suit or a proceeding; or an agent or attorney for a party to a suit or proceeding; and except as provided in Sectionor, knowingly commences, prosecutes, or maintains an action, suit, or proceeding in a justice court. 78A-7-105 78A-7-106
(3) A violation of Subsection (2) is a class B misdemeanor.
