76-9-115. Intentional concealment of identity while committing an offense in public.
(1) As used in this section, "public place" means a place to which the public or a substantial group of the public has access, including: a street or highway; and the common areas of a school, hospital, apartment house, office building, public building, public facility, transport facility, and a retail establishment. (2) An actor commits intentional concealment of identity while committing an offense in public if the actor intentionally or knowingly: wears a mask or other facial obscurant or disguise with the intent to conceal the actor's identity from law enforcement or other government officials; is in a public place; and while wearing the mask or other facial obscurant or disguise, is: committing, or attempting to commit, a local, state, or federal criminal offense; or congregating with other individuals who the actor knows are committing, or attempting to commit, a local, state, or federal criminal offense.
