78B-3-1005. Rulemaking authority.
In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the division may make rules:
(1) establishing standards and processes for determining whether a website contains a substantial portion of material harmful to minors, including methodologies for calculating the percentage of material harmful to minors on a website; and
(2) establishing reasonable age verification standards that commercial entities may meet to comply with Section, including standards for: 78B-3-1002 third-party age verification services; protecting user privacy and data security; verifying the reliability and accuracy of age verification methods; and retaining, protecting, and securely disposing of any information obtained as a result of age verification.
