81-13-404. Postplacement adoptive evaluations.

(1) Except as provided in Subsectionsand, a postplacement evaluation shall be conducted and submitted to the court before the final hearing in an adoption proceeding for a minor child or a vulnerable adult. (2) (3)

(2) The postplacement evaluation under Subsectionshall include: (1) verification of the allegations of fact contained in the petition for adoption; an evaluation of the progress of the adoptee's placement in the adoptive home; and a recommendation regarding whether the adoption is in the best interest of the adoptee.

(3) The exemptions from and requirements for evaluations, described in Subsections,,, and, also apply to postplacement adoptive evaluations. 81-13-403(1)(c) (2)(c) (6) (8)

(4) Upon the request of the petitioner, the court may waive the postplacement adoptive evaluation, unless the court determines that it is in the best interest of the adoptee to require the postplacement evaluation.
