(b) Any person violating subsection (a) of this section or W.S. 9-23-106 is liable for a penalty not to exceed five thousand dollars ($5,000.00). The penalty may be recovered in a civil action and damages shall be assessed by the court. (c) Any action pursuant to this section shall be initiated in Laramie county by the attorney general.
