Indivior was spun off from Reckitt Benckiser Group in 2014 — the British consumer goods conglomerate famous for Lysol disinfectant, Dettol antiseptic, Durex condoms, Strepsils throat lozenges, and Nurofen ibuprofen. Reckitt & Colman (an earlier iteration of the company) had developed the pharmaceutical buprenorphine franchise in the 1970s-2000s, eventually launching Suboxone (buprenorphine/naloxone film) for opioid use disorder treatment. When Reckitt Benckiser decided to focus on consumer goods and health products, it separated the pharmaceutical addiction treatment business as Indivior. The maker of Lysol, the ubiquitous household disinfectant, was simultaneously the world's largest maker of the medication treating opioid addiction — an unusual combination within one consumer goods parent company.

Indivior invented the sublingual film delivery format for buprenorphine/naloxone (Suboxone film) — a technology development that was simultaneously a genuine harm-reduction innovation AND a patent-extension strategy. The clinical rationale for the film over tablets: the film dissolves in 2-3 minutes on the tongue (vs. tablets in 10-15 minutes), is harder to extract and inject (tablet misuse was a documented clinical problem), and has better bioavailability consistency. These are real advantages. The patent strategy: by introducing the film format in 2010 — just as the original Suboxone tablet patents approached expiry — Indivior secured new intellectual property that extended US market exclusivity until 2023-2024, generating approximately $10B in cumulative Suboxone film revenues over 13 additional years of market exclusivity. The DOJ ultimately charged that Indivior used the film-vs-tablet safety argument not just in clinical contexts but in marketing to Medicaid payers to discourage reimbursement of generic tablets — crossing from legitimate IP protection into alleged fraud. In 2019, Indivior PLC (formerly Reckitt Benckiser Pharmaceuticals) was indicted by the US Department of Justice on federal charges of fraudulently marketing Suboxone sublingual film as safer and less prone to diversion and abuse than the older Suboxone tablets — claims the government alleged were not supported by clinical evidence and were designed to prevent generic competition. The indictment described a scheme in which Indivior allegedly misrepresented the safety profile of the film format to Medicaid and other payers, discouraging coverage of generic buprenorphine/naloxone tablets and delaying entry of generic buprenorphine sublingual film.
