Title 10 › Subtitle Subtitle E— Reserve Components › Part I— ORGANIZATION AND ADMINISTRATION › Chapter 1005— ELEMENTS OF RESERVE COMPONENTS › § 10145
People who are required to serve in a reserve must be put into the Ready Reserve of their service when they join. They stay there for their required time unless moved to the Standby Reserve. The Army and Air National Guard of the United States and any units organized and labeled for Ready Reserve are part of the Ready Reserve. Under rules set by the service secretary, qualified reservists or qualified retired regular enlisted members can ask to join the Ready Reserve. But anyone already getting retired pay, or a retired regular enlisted person, cannot be placed there unless the secretary finds their service indispensable. That finding cannot be handed off to a civilian below Assistant Secretary or to a military officer below lieutenant general or vice admiral in charge of personnel policy.
