States must accept a military power of attorney even if it does not follow the State’s usual rules about form, wording, formalities, or recording, and must treat it the same as a power of attorney made under that State’s law. A military power of attorney is any general or special power of attorney notarized under section 1044a or other State or Federal law. The military must, by rule, include a statement on the document saying it is covered by this rule, but the protection still applies if that statement is missing. "State" includes the District of Columbia, Puerto Rico, and U.S. possessions.
