The Secretary of Defense can waive, in whole or in part, certain limits or patient payment rules for health plans bought under sections 1079 or 1086. The waivable items are the limit in the second sentence of 1079(a) and the patient-payment rules in 1079(b) or 1086(b). A waiver is allowed only if the Secretary finds the plan will cost the government less, or will give better services at no extra cost. The Secretary must send a report to the Senate and House Armed Services Committees comparing costs and benefits of the waived plan and a plan without the waiver. The waiver cannot start until 180 days after that report is sent.
