Title 10 › Subtitle A — General Military Law › PART II — PERSONNEL › CHAPTER 55 — MEDICAL AND DENTAL CARE › § 1105
The Secretary of Defense may run a specialized treatment facility program under rules the Secretary creates, after talking with the other military department leaders. The Secretary can name military and civilian health centers as specialized treatment facilities. The Secretary can also ignore the 40-mile rule in section 1079(a)(6) for a specific service if using a different distance saves money. Civilian facilities must serve an area about the same size as military facilities. A covered beneficiary who lives in a facility’s service area may have to get a nonavailability of health care statement before getting that specialized service outside the program. The Secretary may pay or reimburse travel costs, temporary lodging, and meals (meals limited to a per diem rate in the rules) for a covered beneficiary and a person who accompanies them, or provide those things in-kind. The Department may only do this if the total cost is less than other ways of providing the care. “Covered beneficiary” means a person covered under section 1079 or section 1086.
