Title 10 › Subtitle Subtitle A— General Military Law › Part II— PERSONNEL › Chapter 55— MEDICAL AND DENTAL CARE › § 1110b
Lets certain people under age 26 be treated as dependents for TRICARE so they can get coverage. To qualify, a person must have only lost dependent status because of an age limit, be under 26, not be able to join an employer-sponsored plan (see IRC section 5000A(f)(2)), not already be a dependent under other rules, and meet additional rules the Secretary issues that are like HHS rules under section 2714(b). The Secretary must set a monthly premium for this coverage instead of the usual enrollment fees under sections 1075 or 1075a. The premium must equal the cost of the coverage on an actuarial basis. The Secretary will set payment rules. Money collected goes into the Defense Health Program Account under section 1100, is merged with that year’s funds, and is available under subsection (b) of that section for that fiscal year.
